Deferred Disposition/Probation

A request for deferred disposition/probation may be submitted by email, fax, mail, or in person at the Court Clerk's Office within twenty (20) working days from the date of the offense or the appearance date listed on your citation.

You are Eligible for Deferred Disposition If:

1. You did not possess a CDL license (Commercial Driver’s License) on the day of the offense or currently possess a CDL license;
2. you have not participated in a Deferred Disposition Program in the City of Joshua within the last twelve (12) months (the 12 month time period is calculated from the date of the first citation to the date of the second citation).
3. you are not currently participating in a Deferred Disposition Program in the City of Joshua
4. you are not charged with speeding 25 miles or more over the speed limit or speeding 95 miles per hour or more;
5. you are not charged with a violation occurring in a Construction Zone with Workers Present
6. you have not already paid your fine which resulted in a final conviction in this case.

Deferred/Probation Conditions

Deferred Disposition is a form of probation not to exceed 180 days, used by the municipal court and is granted within the courts' discretion. If your request for deferred disposition is granted, as a condition of your probation, you must not receive any additional citations in the City of Joshua, during the deferral period. Other conditions may also be imposed to qualify for deferred disposition. Any conditions or terms required to successfully complete the deferral period will be provided to you in writing by the court.

In addition, you will be required to read and sign the deferred disposition order acknowledging receipt of the information needed to satisfy your deferral terms. If you are under the age of 25 you will be required to complete defensive driving.

Citation Dismissal

At the end of the deferral period, provided you have met all the conditions of your probation, the judge will dismiss your citation without a final disposition. Dismissal of the citation is not reported to the Department of Public Safety, and thus, the offenses are not recorded on your driving and/or criminal record.

Cost & Fees

State Court Costs, Fees, and Deferred Disposition Fee will be due to the Court upon the granting of a request for deferred disposition/probation. The costs and fees will vary according to the offense cited. You may contact the Municipal Court at 817-558-7447 to obtain the exact amount owed.

Failure to Comply

If you fail to comply with any requirements of the deferred order, you will be scheduled for the next available Show Cause Hearing. To discuss your case with the judge as to why your deferment should not be revoked. A letter will be mailed to the last known address provided to the court.

If you fail to appear at this hearing, a final judgment of guilty will be entered. The guilty conviction will be reported to the Department of Public Safety and will appear on your driving and/or criminal record. You may waive your hearing by signing the waiver on your Show Cause Notice or by writing to the court to waive your hearing.
